LoanSites – Terms of Service

Last Updated: September 23, 2026

These Terms of Service (“Agreement”) govern access to and use of services provided by World Wide Design Agency Inc., doing business as LoanSites (“LoanSites,” “we,” “us,” or “our”).

By subscribing to or using LoanSites services, you (“Client,” “you,” or “your”) agree to be bound by this Agreement.

1. Company Information

Legal Entity:
World Wide Design Agency Inc. dba LoanSites

Business Address:
1434 Keele Drive
Carpentersville, IL 60110
United States

Throughout this Agreement, the company will be referred to as LoanSites.

2. Services

LoanSites provides WordPress-based website development, hosting, management, and related digital services on a subscription basis.

LoanSites does not guarantee:

  • Leads
  • Traffic
  • Rankings
  • Revenue
  • Conversion rates
  • Business outcomes of any kind

All services are provided on a best-effort basis.

3. Subscription Model & Optional Website Buyout

LoanSites provides websites as a subscription-based service, with an optional website buyout as described below.

  • Services remain active while subscription payments are current, subject to the buyout transition provisions below
  • Client content remains the property of the Client (see Section 19)
  • Subscription payments alone do not transfer ownership of the Website or LoanSites technology

Optional $6,000 Website Buyout

The Client may buy out an individual website provided under their subscription (the “Website”) for a one-time payment of $6,000 USD per Website. Applicable taxes are included unless expressly stated otherwise in writing before purchase. The buyout is optional and is not required to cancel a subscription. Previously paid subscription, setup, or other service fees do not reduce the buyout price.

How to exercise the buyout:
The Client must email support@loansites.com while the subscription is active, including before a scheduled cancellation takes effect, identifying the Website to be purchased. LoanSites will issue an invoice payable within 10 calendar days unless otherwise agreed in writing. The buyout fee and all undisputed outstanding subscription charges must be paid before delivery.

Files and database delivery:
Within 10 business days after receiving the required payment, LoanSites will securely deliver:

  • All files comprising the Website as then deployed, including its themes, custom code, uploaded media, and transferable plugin files
  • A complete export of the Website’s database, including Website-specific content, settings, and stored data
  • Available Website-specific configuration information and instructions reasonably necessary for a qualified WordPress professional to restore the Website
  • Website-specific administrative credentials or instructions for establishing replacement credentials, where applicable

Delivery will be by secure download or another mutually agreed method. LoanSites will preserve the Website’s files and database from receipt of a timely buyout request through the invoice payment deadline and, if paid on time, through completed delivery. Sections 7, 14, 21, and 22 do not excuse this preservation or delivery obligation, although public access may be suspended where otherwise permitted by this Agreement or required by law.

Third-party components and exclusions:
The transfer does not include other customers’ data, shared server credentials, LoanSites’ internal business systems, or third-party accounts or licenses that cannot legally be transferred. Third-party and open-source components remain subject to their respective licenses. LoanSites will identify known nontransferable components and replacement licenses or external services reasonably necessary to operate the Website before the Client pays the buyout invoice. These exclusions do not permit withholding transferable Website files or the Website’s database.

Rights after buyout:
Upon full payment, the Client may independently host, operate, maintain, and modify the delivered Website, as provided in Sections 19 and 20. The buyout does not transfer ownership of LoanSites’ underlying reusable platform, frameworks, templates, or proprietary systems.

Services after buyout:
The buyout includes the files and database transfer described above. Migration, installation on another host, ongoing hosting, maintenance, updates, technical support, and replacement third-party licenses are not included unless separately agreed in writing. The Client is responsible for arranging replacement hosting and ongoing operation of the Website after LoanSites’ services end.

Unless the Client requests continued services in writing, the subscription for the purchased Website will end at the close of the paid billing period in which delivery occurs. If delivery extends beyond an already-paid period, LoanSites will maintain the Website without additional subscription charges until delivery is completed, subject to any permitted suspension of public access. No further subscription renewals for that Website will occur after delivery unless the Client has requested continued services. Other subscribed websites or services are unaffected.

4. Fees & Billing

The Client agrees to pay all applicable fees associated with their selected subscription plan, which may include:

  • Monthly or annual subscription fees
  • Approved add-on services or features
  • Approved customization requests
  • The optional $6,000 USD per-Website buyout described in Section 3

Billing Terms:

  • All fees are non-refundable unless expressly stated in writing
  • No refunds or credits for partial months
  • No support fees exist outside standard subscription pricing
  • Pricing includes all applicable taxes unless expressly stated otherwise

5. Payment Method

  • A valid credit or debit card is required
  • Subscription fees are billed in advance on a recurring basis
  • Payments are processed via secure third-party processors
  • By subscribing, you authorize LoanSites to charge your payment method automatically

Billing disputes must be submitted within 60 days of the charge.

6. Term & Renewal

  • This Agreement becomes effective on the date of signup
  • Subscriptions automatically renew unless properly canceled
  • Cancellation terms are outlined in Section 22

7. Account Suspension & Termination

LoanSites may suspend or terminate services if:

  • Payments are more than 30 days past due
  • This Agreement is violated
  • The website is used for illegal, misleading, or offensive purposes
  • Client actions present legal, security, reputational, or operational risk
  • Required information is falsified or misleading

LoanSites may suspend services immediately, with or without prior notice, when risk is identified.

8. Regulatory & Compliance Disclaimer

LoanSites does not provide legal, regulatory, compliance, licensing, or professional advice.

Clients are solely responsible for ensuring their website content, advertising, disclosures, and business practices comply with all applicable laws, including but not limited to:

Total liability shall not exceed the fees paid by the Client in the three (3) months preceding the claim.

12. Indemnification

The Client agrees to indemnify and hold harmless LoanSites from any claims, damages, losses, or expenses arising from:

  • Client-provided content

14. Data & Backups

  • Automated backups may be performed on a best-effort basis for operational purposes
  • LoanSites does not guarantee the availability, completeness, or restoration of any backup
  • Except for the preservation and delivery obligations in Section 3, LoanSites is not obligated to restore data, content, or websites

15. Assignment

  • Clients may not assign this Agreement without written consent
  • LoanSites may assign this Agreement at any time

16. Changes to Terms

LoanSites may update these Terms at any time.

  • Continued use constitutes acceptance
  • Subscription pricing changes require 30 days’ notice
  • Later changes to these Terms will not alter the price or transfer terms of a buyout already elected under Section 3, provided the invoice is paid by its deadline, or revoke rights granted under a completed buyout

17. Account Information

Clients must keep contact and billing information current.

18. Notices

Notices may be delivered via:

  • Email
  • Electronic notification
  • Written correspondence

19. Content Ownership & Buyout Rights

  • The Client retains ownership of all content they provide, including their business name, domain name, logos, branding, written copy, images, media, and data
  • LoanSites retains ownership of its website platform, structure, codebase, templates, systems, workflows, and proprietary technology, subject to the post-buyout license below
  • The Client grants LoanSites permission to host and display Client content solely for the purpose of providing the subscribed services and completing any requested buyout transfer

During the subscription:
The Website operates as a managed service. Subscription payments do not purchase the Website or transfer ownership of LoanSites materials.

Following a paid buyout under Section 3:
LoanSites grants the Client a perpetual, worldwide, nonexclusive, royalty-free license to use, host, copy, maintain, and modify LoanSites-owned materials included in the delivered Website solely as part of that Website. The Client may authorize third-party service providers to perform these activities. The license survives cancellation or termination of the subscription and may be transferred with the Website to a subsequent owner, notwithstanding Section 15, provided that owner complies with these license restrictions.

The buyout does not transfer ownership of LoanSites’ reusable technology or grant a right to extract its materials for resale as templates or to create additional websites. Third-party materials remain governed by their respective licenses. Any separate transfer of copyright ownership must be expressly documented in a written agreement signed by LoanSites.

LoanSites will export and transfer the Website’s files and database upon a paid buyout as required by Section 3. Other export, migration, recreation, or transfer services require a separate written agreement.

20. Intellectual Property

The LoanSites platform, design systems, templates, and proprietary technology are protected intellectual property.

Except for the rights expressly granted following a paid buyout under Sections 3 and 19, Clients may not copy, resell, or reuse LoanSites materials without written consent. A buyout does not grant rights to LoanSites’ name, trademarks, other customers’ websites, or technology not included in the delivered Website.

21. Abuse & Conduct

Abusive, threatening, or inappropriate behavior toward staff, partners, or representatives may result in immediate termination without refund.

22. Cancellation

  • Clients must cancel via the designated subscription management method
  • Verbal or informal requests do not constitute cancellation unless confirmed in writing
  • Upon cancellation, services may be deactivated and content deleted, subject to the buyout preservation, delivery, and transition requirements in Section 3
  • Except for its obligations under Section 3, LoanSites is not responsible for content recovery after cancellation
  • Cancellation does not require payment of a buyout fee and does not itself transfer Website files, the database, or rights to LoanSites materials
  • A Client wishing to buy out the Website must exercise the option before cancellation becomes effective, as described in Section 3

23. Force Majeure

LoanSites shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet outages, power failures, labor disputes, or governmental actions.

24. U.S. Company Representation

LoanSites is operated by World Wide Design Agency Inc., a United States company. The company’s principal place of business, executive management, and decision-making authority are based exclusively in the United States.

25. Governing Law & Venue

This Agreement is governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in state or federal courts located in Illinois.

26. Entire Agreement

This Agreement, together with any separately signed agreement between LoanSites and the Client, constitutes the entire agreement between the parties concerning the services and supersedes prior agreements or understandings concerning the same subject matter. If a separately signed agreement conflicts with these Terms, the separately signed agreement controls. Updates to these Terms do not amend that signed agreement unless both parties agree in writing.

If any provision is found unenforceable, the remaining provisions remain in effect.
